These Terms of Service (hereinafter “Terms”) shall apply to any action when customers use the JAGDA ONLINE SHOP (URL: http://shop.jagda.org/) (hereinafter “this site”), managed by the Japan Graphic Designers Association Inc. (hereinafter “JAGDA”; also referred to as “we, ” “us” or “our”).


Article 1: Definition of Customers

“Customers” refers to those who purchase items through this site.


Article 2: Orders

1. Customers are entitled to place orders for items on this site by agreeing to these Terms and by inputting necessary information, such as their name, address, e-mail address, telephone number and credit card details.
2. We may cancel orders after they are processed in the following cases: when there is nothing in stock for the items chosen, when unauthorized credit card details are used, or if a customer has breached these Terms in the past.
3. Customers cannot cancel their orders after they are processed.


Article 3: Use of Personal Data

Any personal data of customers provided to us in order to place orders is processed based on our privacy policy.


Article 4: Shipping Fee

Customers shall generally be liable for the shipping fee, including the cost for re-shipping in cases when the customer is absent during the time of delivery.


Article 5: Method of Payment

1. All payments for purchased items and shipping fees shall be made by credit card.
2. We accept VISA and MASTERCARD credit cards.


Article 6: Shipping

1. Purchased items are shipped via our authorized carrier.
2. Purchased items are shipped to the customer´s specified domestic or international mailing address.
3. Neither our carrier nor JAGDA offers unpacking, installation or collection of packaging materials.
4. We normally dispatch purchased items within two weeks of the placement of an order, unless otherwise stated.


Article 7: Exchanges and Returns

1. We do not accept exchanges or returns of purchased items. However, in cases where a customer receives an incorrect or defective item, we accept exchanges (or returns in case of stock shortage). This applies only if the customer notifies us and returns the items with the invoice within seven days.
2. In cases of incorrect or defective items, we shall be liable for shipping fees.
3. In cases of incorrect or defective items, we shall refund the price of incorrect or defective items in the specified manner.


Article 8: Governing Law

These Terms are governed by and shall be construed in accordance with Japanese law.


Article 9: Agreed Jurisdiction

If legal proceedings regarding the use of this site are to take place between customers and JAGDA, the Tokyo District Court shall be the first agreed-upon court of jurisdiction.
